1. Introduction

These Terms and Conditions ("Terms") govern your use of our website, www.brickston-studios.com ("Site"), and studio services provided by Brickston Studios OÜ (“Brickston”, “we”, “us”, “our”) through the Site and any third-party platforms.

By using our services, you confirm that you have read and agree to be bound by these Terms, including any schedules, rules, or policies referenced within them.

2. Defined Terms

Consumer: An individual buying services for personal use, not for business purposes.
Intellectual Property Rights: Includes all copyrights, trademarks, and proprietary rights related to our Site and services.
Order: A booking for a studio reservation through the Site or third-party platforms.
Services: The studio rental and associated amenities offered by Brickston Studios.

3. Registration, Account, and Password

To make a reservation, you must register for an account using accurate, up-to-date information, including a valid email address. You must be at least 18 years old and may hold only one account.

You are responsible for maintaining the confidentiality of your password and agree not to share your login details. If unauthorized use of your account occurs, notify us immediately. Accounts inactive for over 12 months may be terminated.

4. Booking and Reservations

Reservations can be made online through the Site or third-party booking platforms. Please verify your booking details and payment information carefully; Brickston is not liable for errors in reservations made by you.

• Payment: Payments are processed online via debit or credit card. Pre-authorization may be held for any potential damage or additional fees incurred.

• Gift Cards and Credits: Credits from cancellations, marketing promotions, or gift cards expire three months from issuance. Only one voucher may be used within a 24-hour period.

• Non-Estonian Users: Estonian law will apply, but consumers retain their rights under the consumer laws where they reside.

5. Cancellations and Refunds

• User Cancellations: Reservations may be canceled up to 4 hours before the booking start time, with the amount credited to your account. If canceled 48+ hours in advance, we may, at our discretion, refund the amount to your payment method.

• Late Cancellations: Cancellations made within 4 hours of the booking time are non-refundable. Late arrivals are not eligible for re-scheduling or refunds.

• Grace Period: Cancellations within one hour of booking may receive a full credit refund, provided they are made more than 2 hours before the scheduled start time.

6. Restrictions and User Obligations

You agree to comply with all applicable laws and regulations and our Site’s rules, including the schedules attached to these Terms. Specifically:

• Do not allow unauthorized individuals to access Brickston Studios during your reservation.

• Do not tamper with or damage any equipment, CCTV, fire alarms, or safety equipment.

• Ensure that you and your guests comply with health and safety rules, including fire evacuation procedures and any COVID-19 guidelines.

• Maintain a clean environment and dispose of personal rubbish in provided bins. You are responsible for any damage caused by liquids or misuse of equipment.

• Do not use or bring illegal substances, smoke, or vape within the studio premises.

• Vacate the studio at the end of your booking time, as additional charges apply for overtime usage.

• Report any damaged or missing equipment immediately upon arrival, as undetected issues may result in liability for repair costs.

7. Extra Fees and Charges

The following charges may apply if rules are breached:

• €60 for vaping indoors; €100 for smoking indoors.

• €150 minimum for fire alarm activation due to smoking or vaping.

• Up to €300 for excessive mess in the studio or communal areas.

• €100 per person for exceeding capacity limits.

• €300 minimum for tampering with or damaging CCTV, fire alarms, or fire safety equipment.

• Additional fees for misuse or damage to studio property, up to the full repair/replacement cost.

• Charges for overstaying the reservation period, billed hourly at the standard rate.

Brickston Studios reserves the right to levy additional fees or impose restrictions on repeat violators.

8. Liability and Indemnity

Consumer Liability: We are liable for foreseeable losses caused by our failure to exercise reasonable care. However, we are not liable for business losses, indirect losses, or losses caused by events beyond our control.

Business Liability: For users booking for business purposes, Brickston’s liability is limited to the fees paid for services within the past 12 months. Brickston is not liable for indirect, special, or consequential losses.

Indemnity: You agree to indemnify Brickston and its affiliates from any damages or liabilities arising from your breach of these Terms, including legal fees and costs.

9. Lost Items Policy

Brickston Studios is not responsible for lost items. We will notify you if an item is found but are not able to search CCTV footage to locate personal belongings.

10. Intellectual Property Rights

All intellectual property related to the Site and services remains the property of Brickston and/or its licensors. You may not use, reproduce, or distribute any content provided by Brickston without express permission.

11. Privacy and Data Use

We use your personal information to provide services, process payments, and keep you updated on similar offerings unless you opt out. For full details, see our Privacy Policy on the Site.

12. Breach, Suspension, and Termination

Brickston reserves the right to suspend or terminate services, including canceling reservations and deleting accounts, if a user violates these Terms. In cases of suspected fraud or misconduct, accounts may be suspended until proof of compliance is provided.

13. Governing Law and Dispute Resolution

These Terms are governed by Estonian law. If you are a consumer, you may also pursue alternative dispute resolution. Consumers may submit disputes through the European Commission's Online Dispute Resolution platform.

14. General Terms

• Force Majeure: Brickston is not liable for failure to perform due to events beyond our control (e.g., natural disasters, pandemics, governmental restrictions). We reserve the right to terminate services after 4 weeks of interruption due to such events.

• Amendments: Brickston may modify these Terms at any time. Continued use of the services constitutes acceptance of revised Terms.

• Entire Agreement: These Terms, along with the Privacy Policy and any specific terms on the Site, represent the complete agreement between you and Brickston Studios.
